On August 1, 2017, Johnson filed to sell WAMI to Brantley for an LMA prepayment up to $16,000 and ten years of rent free use of one tower and five years of rent free use at another. The same day Brantley applied for a new translator in the then ongoing AM translator filing window for use with WAMI. The CP was granted in January 2018, with the following condition, “Grant of this authorization is conditioned on the common ownership, in perpetuity, of this facility and the specified AM primary station. Any violation of this condition shall result in the rescission of the grant of this authorization and the dismissal, with prejudice of the associated application and, if applicable, cancellation of the associated construction permit.”
The assignment of WAMI was granted two months later requiring closing of the sale within 90 days. The sale was never consummated and in December 2022, Brantley filed to transfer W237FK to Johnson instead for $138. In an objection, Marble City Media argued that Brantley failed to comply with the terms of its license authorization by not having the translator be co-owned with the parent WAMI signal. The FCC agreed stating, “In order to comply with this condition, Brantley or Johnson was to submit to the Commission by May 29, 2018, a notification of the completed consummation of the WAMI assignment in letter form showing the date the acts necessary to effect the transaction were completed.”
CSN International, Inc. has entered into a Consent Decree and agreed to a $10,000 civil penalty for failing to disclose that it had not reported some members of its governing board on various applications as required by the application instructions and contrary to CSN?s certifications that the applications were complete and satisfied the relevant criteria.
The FCC has amended the FM Table of Allotments to add a 102.3 Class A in Dennison OH following a request by Western Radio Group and a pair of petitions against due to the potential future displacement of secondary LPFM WDNP-LP Dover.
The commission has also restored the previously unbid allocation for 105.9 Hardwick VT after a late filed request by Shire and Shore Communications promising to bid on it in the next available auction.
DeletionsGood Karma Brands’ former Sports “KNR2” 1540 WWGK Cleveland OH was cancelled after being silent since December 2021. The FCC sent Good Karma a letter requesting information on the station’s operating status this week despite the company sending a cancellation letter for the license last August.
Providence Educational Foundation’s 90.7 KPEF White Castle LA has been deleted after being silent since May 2021.
